This Privacy Policy describes Our policies and procedures on the collection, use, and disclosure of Your information when You use the Moon AI mobile application (the "Service") and tells You about Your privacy rights and how the law may protect You.

We use Your data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.

1. Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

For the purposes of this Privacy Policy:

  • Account: Refers to a unique account potentially created for You to access our Service or parts of our Service (if applicable).
  • Application: Refers to Moon AI, the software program provided by the Company.
  • Company: (referred to as either "the Company", "We", "Us" or "Our") refers to Moon Ai Inc.
  • Device: Means any device that can access the Service such as a computer, a cellphone, or a digital tablet.
  • Face Data: Refers to information about human faces, such as facial geometry or features, processed by certain features of the Application.
  • Personal Data: Means any information that relates to an identified or identifiable individual.
  • Service: Refers to the Application.
  • Service Provider: Means any natural or legal person who processes data on behalf of the Company. This includes providers of hosting (e.g., Google Cloud), analytics (e.g., Firebase), AI model processing, and other support services.
  • Usage Data: Refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (e.g., features used, duration of session).
  • User Content: Refers to the photographs, video clips, audio recordings, text prompts, and other materials You upload, input, or generate using the Service.
  • You: Means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

2. Collecting and Using Your Personal Data

Types of Data Collected

Personal Data: While using Our Service, particularly if account registration or support is involved, We may ask You to provide Us with certain personally identifiable information, such as an email address for contact or account management.

User Content & Information from Your Device: To provide the core features of Our Application (like video generation, background removal, lipsync, image-to-video, text-to-video), We require access to and process User Content. With Your prior permission, We may collect:

  • Pictures, videos, audio, and other information from your Device's camera and photo/media library.
  • Text prompts you enter.

We use this User Content solely to provide the requested features of Our Service, and to improve and customize Our Service. This User Content needs to be processed, which may involve uploading it temporarily to the Company's servers and/or a Service Provider's server (e.g., Google Cloud, AI model providers). You can typically enable or disable access to your camera and photo library at any time through Your Device settings.

Face Data: Certain features of the Service process Face Data present in the photos or videos you provide (See Section 10: "Face Data" below for details).

Usage Data: Usage Data is collected automatically when using the Service. It may include information such as Your Device's Internet Protocol (IP) address, device type, operating system version, the features of our Service that You use, the time and date of Your usage, the time spent on certain tasks, unique device identifiers (where applicable), crash data, and other diagnostic data, often collected via Service Providers like Firebase.

Use of Your Personal Data

The Company may use collected data for the following purposes:

  • To provide and maintain our Service: Including processing User Content to generate outputs, enabling features, and monitoring the usage of our Service.
  • To manage Your Account (if applicable): To manage Your registration as a user and provide access to different functionalities.
  • To improve our Service: Using Usage Data and feedback for data analysis, identifying usage trends, determining the effectiveness of features, and improving the Application.
  • To contact You (if applicable): By email or other electronic means you provide, regarding support requests or potentially important updates related to the Service functionalities (we will not use it for unrelated marketing unless you opt-in).
  • To manage Your requests: To attend and manage Your requests to Us (e.g., via the support email).
  • For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
  • For other purposes: We may use Your information for other purposes compatible with the above, or where required or permitted by law.

3. Sharing of Your Personal Data

We may share Your information in the following situations:

  • With Service Providers: We share information with Service Providers to facilitate our Service, provide the Service on our behalf, perform Service-related tasks (e.g., data storage via Google Cloud, analytics via Firebase, processing via third-party AI models), or assist us in analyzing how our Service is used. These providers are obligated to protect your data and use it only for the purposes we specify.
  • With Third-Party AI Model Providers: As the core functionality relies on various AI technologies, your User Content (including Face Data) is necessarily processed by these underlying third-party AI services to generate the results you request within the App. We integrate these technologies but do not control their independent data processing. We are not responsible for the actions or privacy policies of these third-party AI providers, and You use these features at Your own discretion.
  • For Business Transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
  • With Affiliates (if applicable): We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  • By Law or to Protect Rights (Disclosure of Your Personal Data): Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency). The Company may also disclose Your Personal Data in the good faith belief that such action is necessary to:
    • Comply with a legal obligation.
    • Protect and defend the rights or property of the Company.
    • Prevent or investigate possible wrongdoing in connection with the Service.
    • Protect the personal safety of Users of the Service or the public.

4. Retention of Your Personal Data

The Company will retain Your Personal Data and User Content only for as long as is necessary for the purposes set out in this Privacy Policy. User Content is generally stored temporarily on servers (e.g., Google Cloud) to perform the requested processing and facilitate the Service. We aim to retain data only for the minimum necessary period required for functionality, operational needs, or as required to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies. Usage Data is generally retained for shorter periods, except when this data is used to strengthen security, improve functionality, or we are legally obligated to retain it for longer.

5. Transfer of Your Personal Data

Your information, including Personal Data and User Content, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located (such as our Service Providers like Google Cloud, Firebase, and AI model providers). This means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of Your jurisdiction. Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer. The Company will take steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy.

6. Delete Your Personal Data

You may have the right to delete or request that We assist in deleting the Personal Data and User Content that We have collected about You, subject to certain exceptions. Where functionality permits within the App, deleting content may initiate its removal from active systems. You can also request deletion by contacting us. Please note that We may need to retain certain information when we have a legal obligation or lawful basis to do so.

7. Security of Your Personal Data

We use administrative, technical, and physical security measures designed to protect Your Personal Data and User Content. While We strive to use commercially acceptable means to protect Your information, We cannot guarantee its absolute security. No method of transmission over the Internet, or method of electronic storage is 100% secure. Any transmission of data is at your own risk.

8. Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

9. Face Data

Collection and Use: Certain features of Our Service (e.g., lipsync, potentially others) collect and process Face Data from the photos or videos You provide. This processing occurs to enable the specific feature You choose to use within the Application.

Retention: Consistent with our general policy on User Content, We do not permanently store your raw Face Data. Face Data is processed in near real-time to provide the functionality. If temporary storage on our servers or a Service Provider's server is required solely for the technical processing of your request (e.g., to apply an effect or generate the lip-sync), the Face Data is retained only for the minimum duration necessary to complete that processing and render the service. After the processing is complete, the identifiable Face Data used for the generation is deleted from our active systems. We do not use your Face Data to train our AI models unless we obtain separate explicit consent.

Sharing: As described in Section 3, providing features that use Face Data requires sharing this data with the underlying third-party AI Service Providers that perform the processing. These providers are engaged solely to enable the feature You requested.

Deletion: Any temporarily stored Face Data associated with your User Content is subject to deletion as described in Sections 4 and 6.

10. Links to Other Websites

Our Service may contain links to other websites that are not operated by Us. If You click on a third-party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

THE SERVICE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVER(S) THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. (Note: Liability limitations are subject to state laws). YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO STOP USING THE SERVICE.

12. Changes to this Privacy Policy

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date at the top. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page. Your continued use of the Service after changes are posted constitutes your acceptance of those changes.
